Terms of Service

Please read these terms carefully before using MarketFlow AI.

1. Agreement

By accessing or using MarketFlow AI ("the Service"), you agree to these Terms of Service ("Terms"). You are contracting with Lumyn AI Ltd (trading as MarketFlow AI) ("we", "us", or "our"), a company registered in Ghana. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms. Continued use of the Service constitutes acceptance of these Terms.

2. The Service

MarketFlow AI is software-as-a-service. It provides tools for AI-assisted content creation, social media planning and publishing, WhatsApp Business messaging you configure for your own customers, CRM, and related analytics. After you subscribe (or start a trial), you receive a login to the MarketFlow AI dashboard to use those features according to your plan. Features may change over time. We may add, modify, or discontinue features with reasonable notice where practicable. We do not guarantee uninterrupted or error-free operation.

3. Account registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity under your account
  • You must notify us promptly of any unauthorized use
  • One person or legal entity may not maintain more than one free-tier account without permission

4. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, or fraudulent purposes, or to send spam
  • Send unsolicited messages or content that violates anti-spam or platform rules
  • Publish content that infringes intellectual property or privacy rights of others
  • Upload malware, probe or scrape the Service, attempt to breach security, or interfere with other users
  • Reverse engineer or resell the Service except as permitted by law
  • Use the Service to harass, discriminate, or distribute hate speech or illegal content
  • Violate the terms of connected third-party platforms (Meta, WhatsApp, TikTok, etc.)

We may suspend or terminate accounts for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations.

5. Your content and AI output

You retain ownership of content you create, upload, or schedule through the Service ("Your Content"). You grant Lumyn AI Ltd a limited license to host, process, display, and transmit Your Content solely to operate the Service, including publishing to channels you authorize.

You are solely responsible for prompts and content you submit, how you use outputs, and for reviewing and approving content before publication. AI output may be inaccurate or incomplete. Do not rely on it as professional, legal, medical, or financial advice.

You must not use the Service to generate or distribute:

  • Illegal content or instructions to commit wrongdoing
  • Non-consensual intimate imagery, deepfakes, or impersonation of a real person
  • Hate, harassment, threats, or incitement to violence
  • Malware, credential theft, or attempts to bypass safety controls
  • Personal data published without a lawful basis

You must have rights to any material you upload. Rights-holders may request takedown by emailing softcode25@gmail.com with the URL or content ID and proof of rights. We may remove or restrict content, refuse or filter outputs, suspend accounts, or limit features for policy violations or suspected abuse, including repeated infringement.

6. Third-party integrations

Connecting Facebook, Instagram, WhatsApp, TikTok, or other third-party services is subject to those providers' terms and policies. We are not responsible for third-party services, outages, or policy changes. You may disconnect integrations at any time in Settings.

7. Subscription, payment, and Paddle

Paid plans are billed according to the prices shown at checkout or in your account, in the currency of your billing country (USD via Paddle for international customers; GHS via Paystack for Ghana). Unless otherwise stated at checkout, subscriptions renew automatically at the end of each billing period until you cancel. Taxes may apply. We may change pricing with reasonable notice; continued use after the effective date constitutes acceptance.

New paid plans include a 14-day trial. A payment method is required to start the trial. You are not charged the plan price until the trial ends.

Our international order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for those orders. Paddle provides customer service inquiries and handles returns. Payment, renewal, tax, and related buyer terms are described in Paddle's Buyer Terms.

Cancellation and refunds are described in our Refund and Cancellation Policy. You must accept these Terms and that policy before completing a paid purchase.

8. Intellectual property

The Service, including software, design, trademarks, and documentation (excluding Your Content), is owned by Lumyn AI Ltd (operating as MarketFlow AI) and its licensors. These Terms do not grant you any rights to our intellectual property except the limited, non-exclusive, non-transferable right to use the Service as intended under your plan.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION, OR SPECIFIC MARKETING OR BUSINESS RESULTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMYN AI LTD AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Lumyn AI Ltd from claims arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, repeated or serious policy violations, or as required by law. Upon termination, your right to use the Service ends; provisions that by nature should survive (e.g. liability limits, indemnity) will survive.

13. Governing law

These Terms are governed by the laws of Ghana, without regard to conflict-of-law principles, unless mandatory local consumer protection laws in your country provide otherwise.

14. Changes

We may update these Terms. We will post the new version on this page and update the "Last updated" date. Continued use after changes become effective constitutes acceptance.
