Terms of Service

Please read these terms carefully before using MarketFlow AI.

1. Agreement

By accessing or using MarketFlow AI ("the Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. The Service

MarketFlow AI provides tools for AI-assisted content creation, social media planning and publishing, WhatsApp marketing, CRM, and related analytics. Features may change over time. We may add, modify, or discontinue features with reasonable notice where practicable.

3. Account registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity under your account
  • You must notify us promptly of any unauthorized use
  • One person or legal entity may not maintain more than one free-tier account without permission

4. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, or fraudulent purposes
  • Send spam, unsolicited messages, or content that violates anti-spam laws
  • Publish content that infringes intellectual property or privacy rights of others
  • Upload malware, attempt to breach security, or interfere with the Service
  • Reverse engineer or scrape the Service except as permitted by law
  • Use the Service to harass, discriminate, or distribute hate speech or illegal content
  • Violate the terms of connected third-party platforms (Meta, WhatsApp, etc.)

We may suspend or terminate accounts that violate these rules or pose risk to the platform or other users.

5. Your content

You retain ownership of content you create, upload, or schedule through the Service ("Your Content"). You grant MarketFlow AI a limited license to host, process, display, and transmit Your Content solely to operate and improve the Service, including publishing to channels you authorize.

You are solely responsible for Your Content and must have all rights necessary to use and share it. AI-generated suggestions are provided as aids; you are responsible for reviewing and approving content before publication.

6. Third-party integrations

Connecting Facebook, Instagram, WhatsApp, or other third-party services is subject to those providers' terms and policies. We are not responsible for third-party services, outages, or policy changes. You may disconnect integrations at any time in Settings.

7. Subscription and payment

Paid plans are billed according to the pricing shown at signup or in your account. Fees are non-refundable except where required by law or stated in a specific offer. We may change pricing with advance notice; continued use after the effective date constitutes acceptance.

8. Intellectual property

The Service, including software, design, trademarks, and documentation (excluding Your Content), is owned by MarketFlow AI and its licensors. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION, OR SPECIFIC MARKETING OR BUSINESS RESULTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKETFLOW AI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless MarketFlow AI from claims arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for violation of these Terms, non-payment, or extended inactivity. Upon termination, your right to use the Service ends; provisions that by nature should survive (e.g. liability limits, indemnity) will survive.

13. Governing law

These Terms are governed by the laws of Ghana, without regard to conflict-of-law principles, unless mandatory local consumer protection laws in your country provide otherwise.

14. Changes

We may update these Terms. We will post the new version on this page and update the "Last updated" date. Continued use after changes become effective constitutes acceptance.
